The Washington Supreme Court ruling, stays evictions for termination of tenancy for intent to sell or move-in are on hold.
On February 4, 2021 the Washington Supreme Court signed a ruling that places a hold on evictions related to the termination of tenancy due to the owner’s intent to sell or move-in. The issue before the Washington Supreme Court is whether or not the Federal CDC Eviction Moratorium requires a tenant to vacate after receiving notice to terminate tenancy for the owner’s intent to sell or move-in. The Washington Supreme Court will hear oral argument on May 13.
Owners may continue to serve 60-day notices to terminate tenancy for their intent to sell or move-in to the property.
A Texas court ruled the CDC eviction moratorium as unconstitutional. Both the CDC moratorium and the state moratorium are scheduled to expire on March 31, 2021. I am expecting both to be extended. If the CDC moratorium isn’t extend than the issue before the Washington Supreme Court should be mute and provide you with a path forward to possession for notices with a termination date after March 31.
