City of Auburn: Proposed Rental Housing Policy

July 20, 2020

TODAY the City Council for the City of Auburn will vote on a new suite of Rental Housing Policies:

  1. Distribution of information
    1. Written rental criteria
    2. City of Auburn informational website to provide information about the property, landlord and code enforcement
    3. Website address for Washington Secretary of State for information on how to vote and change of address
  2. Distribution of information packet (provided with rental agreement)
    1. Provided by City of Auburn
    2. Summary of local, state and fair housing landlord-tenant laws
    3. Legal resources available to tenant
  3. Notice of resources to be served with notices under RCW 59.12.030
  4. 120 day notice of rent increase more than five percent (5%)
    1. Tenant may terminate tenancy at any time after receiving notice and owe pro rata rent
  5. Late fee capped at $10.00 per month
  6. Security deposit capped at one months' rent
  7. Proposed sale of low-income housing
  8. Just Cause Eviction (Termination of Tenancy)
    1. Non-payment of rent
    2. Late rent four or more times in a 12-month period
    3. Fails to comply with 10-day notice three or more times in a 12-month period
    4. Owner or immediate family member want to occupy unit - 90 days notice
    5. Owner wants to sell unit - 90 days notice
  9. Penalties of $1,000-$2,000
